PLEDGE OF ALLEGIANCE

CALL TO THE PUBLIC: Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date.

PRESENTATIONS, PROCLAMATIONS & APPOINTMENTS: Note: During this segment of the agenda, board members may discuss the presentations and proclamations, and may announce appointments to the Yuma County Planning and Zoning Commission and the Yuma County Board of Adjustment. No legal actions will be taken.

1.        Presentation of "The County Line" by Yuma 77, the Yuma County Government Channel. NO ACTION

2.        County Administration/Grants: Presentation regarding the Yuma County Owner Occupied Housing Rehabilitation Program.   NO ACTION

CONSENT CALENDAR:  The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action.  

1.        Assessor: Approve Tax Roll Corrections as listed in batch dated June 18, 2018, pursuant to ARS Title 42, Chapter 16, Article VI.  (A full listing of all corrections is available from the Clerk of the Board of Supervisors.)   APPROVED AS PRESENTED

2.        Finance: Approve the Accounts Payable Demands disbursed in the amount of $1,412,951.28 and Payroll in the amount of $1,563,973.22 during the period of May 07, 2018 through May 18, 2018 (A detailed listing is available for review in the Office of the Clerk of the Board of Supervisors.)   APPROVED AS PRESENTED

3.        Clerk of the Board: Approve the following minutes: May 10, 2018 Special Budget Session.  APPROVED AS PRESENTED

4.        Clerk of the Board: Approve the following appointments to the Yuma County Industrial Development Authority (IDA), for 6-year terms that will expire on April 17, 2024: a) Re-appointment of William P. Gresser, Sr., and b) Appointment of Sandra Navarrete to replace Silvia Gunderman.  APPROVED AS PRESENTED

5.        Clerk of the Board:  Recommend State approval of a Regular Liquor License Application Series No. 6, submitted by James Edward Shaffer, dba Roxy, 830 Magnolia Avenue, Yuma, Arizona 85364, State License No. 06140039.   BOS RECOMMENDED APPROVAL

6.        Clerk of the Board: Recommend State approval of a Temporary Extension of Premises/Patio Permit for a Regular Liquor License application submitted by Jose Luis Garcia, Jr. dba Tarros Chicali Sports Bar, LLC, 2526 E. 16th Street, Yuma, Arizona, State License No. 07140032.  BOS RECOMMENDED APPROVAL

7.        Clerk of the Board:  Action to declare the official newspaper of the county to be the Yuma Sun, 2055 South Arizona Avenue, Yuma, for all advertising, publications and printing required to be done or made by all departments ofcounty government, for the period July 1, 2018 through June 30, 2019.   APPROVED AS PRESENTED

8.        County Administrator/Elections: Action to correct the name and address for the San Luis Library Vote Center on the Yuma County Vote Center list to read as shown on Exhibit A. (Exhibit A is available for review from the Office of the Clerk of the Board of  Supervisors.)   APPROVED AS PRESENTED

9.        County Administrator/Elections: Action to: a) Cancel the August 30, 2018 elections for all Precinct Committeemen in the Democratic and Libertarian parties, and appoint and deem elected all individuals who filed nomination papers for precinct committeemen in their respective precincts and parties, and; b) Cancel said election for all Precinct Committeemen in the Republican party except Precinct No. 39, and appoint and deem elected all individuals who filed nomination papers for precinct committeemen in their respective precincts as listed in Attachment A. (Attachment A is available for review from the Office of the Clerk of the Board of  Supervisors.)   APPROVED AS PRESENTED

10.      County Administrator/Elections:  Action by the Board of Supervisors to reaffirm the existing precinct boundaries for the Yuma County 2018 election cycle as shown in Exhibit A. (Exhibit A is available for review from the Office of the Clerk of the Board of  Supervisors.)   APPROVED AS PRESENTED

11.      Public Health Services District: Pursuant to Arizona Revised Statutes §11-251.08, set a public hearing for Wednesday, July 18, 2018 to receive comments regarding proposed revisions to the Fee Schedule for the
Yuma County Public Health Services District. APPROVED AS PRESENTED

12.      Public Defender: Action to appoint Raymond Arthur Hanna to the position of Attorney IV, Position No. 2172.001, at Step 8.5, Grade 364 (above midpoint).  APPROVED AS PRESENTED

13.      Public Works: As the Board of Directors of Six-Street Lighting District No. 2016-02, accept the Arizona Public Service Contract for street light construction, maintenance and repair for said District and authorize the
Chairman of the District to execute the contract pending approval by legal counsel.   APPROVED AS PRESENTED

14.      Superior Court/Juvenile Court:  Authorize the Chairman to sign the Fiscal Year 2018-19 Intergovernmental Agreement between Juvenile Court and the Cocopah Indian Tribe for the detention of Cocopah Indian Tribe juveniles, effective July 1, 2018 to June 30, 2019.    APPROVED AS PRESENTED

15.      Superior Court/Juvenile:  Adopt Budget Amendment Resolution No. 18-143, increasing budget authority by $10,000 in the Aztec High School Fund. APPROVED AS PRESENTED

16.      Superior Court: Adopt Budget Amendment Resolution No. 18-144 to move $5,000 in Contingency to Supplies and Service line items in Superior Court Law Library Fund.  APPROVED AS PRESENTED

17.      Development Services/Flood Control District/Health Services District: Reappoint Jerry Cook to serve as Hearing Officer for Yuma County Zoning, Animal Control, and Floodplain violations for a term that begins July 1, 2018 and ends
June 30, 2020.   APPROVED AS PRESENTED

18.       Sheriff's Office: Authorize the Chairman to sign the professional services agreement between Yuma County and Victor Alvarez, M.D. for the County Medical Examiner Services for Fiscal Year 2018-2019, effective July 1, 2018 through June 30, 2019 in an amount not to exceed $236,708.   APPROVED AS PRESENTED

19.      County Attorney: Approve and authorize the Chairman to execute the Legal Representation Agreement with the law firm of Helm, Livesay & Worthington, LTD., 1619 E. Guadalupe, Suite One, Tempe, Arizona, to defend the County's interests in Solarcity Corporation, LTD., et al., v. ADOR, et al., No. TX2014-000129 and its progeny.  APPROVED AS PRESENTED

20.       County Attorney:  Adopt Budget Amendment Resolution No. 18-147 increasing budget authority for VOCA Grant Fund 02210 in the amount of $30,000.  APPROVED AS PRESENTED

Chairman recesses the Yuma County Board of Supervisors and convenes as the Yuma County Housing Governing Board.

HOUSING GOVERNING BOARD - DISCUSSION CALENDAR: The Board will open each of the following items separately for discussion and action, as appropriate.

1.        Housing: Adopt Resolution No. 2018-24 authorizing the amount of $5,038.09 to be written off as bad debt accounts.  APPROVED AS PRESENTED

2.        Housing: Adopt and authorize the Chairman to sign HUD 52574 PHA Board Resolution No. 2018-25 approving the Yuma County Housing Department’s Fiscal Year 2018-19 operating budget in the amount of $1,216,585.  APPROVED AS PRESENTED

3.        Housing: Approve the calculation of the operating budget for Fiscal Year Ending June 30, 2019 for the Yuma County Housing Department’s Section 8  Housing Choice Voucher program in the amount of $3,007,753.  APPROVED AS PRESENTED

Chairman adjourns the Yuma County Housing Governing Board and reconvenes the Yuma County Board of Supervisors in Regular Session.

DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate.

1.        Development Services/Engineering: In accordance with A.R.S. 11-251 (9) & (48), conduct an auction at 9:00 a.m., or as schedule permits, of Assessor's Parcel No. 664-01-067, a county-owned excess parcel, and authorize the County Engineer to execute the deed transferring the property to the highest bidder at or above the minimum bid.  If there are no successful bids, continue this item and authorize the county engineer to return this item to the Board when there is sufficient interest to conduct an auction.  NO ACTION

2.        County Administrator/All Special Taxing Districts: Actions regarding the Yuma County Annual Budget for Fiscal Year 2018-19 as follows: a) Conduct a combined public hearing on the Fiscal Year 2018-19 Annual Budget and the Truth and Taxation (primary & secondary property tax levies); b) Adopt Resolution No. 2018-19,  a joint resolution of the County, the Yuma County Flood Control District, Public Health District, Jail District, Library District and all Improvement and Special Districts, adopting the Yuma County Budget for Fiscal Year 2018-19; and c) Adopt Resolution No. 2018-20, a joint resolution of the County, the Yuma County Flood Control District, Public Health District, Jail District, and Library District, adjusting Employee Compensation and Program Funding.   APPROVED AS PRESENTED

PLANNING & ZONING AGENDA: Full legal descriptions of property sites for all Rezoning Cases are available for public review at the Yuma County Board of Supervisors' Office.

REZONING -- REGULAR PUBLIC HEARING ITEMS: Staff will make a full presentation on each of the following items, followed by separate discussion, public hearing, and action by the Board of Supervisors. 

REZONING -- REVERSION HEARINGS: In accordance with Section 404.01(I)(7) of the Yuma County Zoning Ordinance, the Board will conduct a hearing to grant an extension of time to comply with the Schedule for Development, determine compliance with the Schedule for Development, or cause the property to revert to its former zoning classification in the following cases:

1.        Development Services/Planning & Zoning:  Rezoning Case No. 07-38:  In accordance with Section 404.01(I)(7) of the Yuma County Zoning Ordinance, action to grant an extension of time to comply with the Schedule for Development or cause the property to revert to its former Rural Area-10 acre minimum (RA-10) zoning classification for Assessor's Parcel No. 729-04-089, located at the southwest corner of County 12th Street and Avenue 15E, Yuma Arizona.  REVERT TO PREVIOUS ZONING DESIG.

2.        Development Services/Planning & Zoning:  Rezoning Case No. 13-02: In accordance with Section 404.01(I)(7) of the Yuma County Zoning Ordinance, action to grant an extension of time to comply with the Schedule for Development or cause the property to revert to its former Rural Area-10 acre minimum (RA-10) zoning classification for Assessor's Parcel No. 748-27-002, located in the vicinity of County 15th Street and Avenue 4½ E Yuma Arizona.  REVERT TO PREVIOUS ZONING DESIG.

3.        Development Services/Planning & Zoning: Rezoning Case No. 03-38: In accordance with Section 404.01(I)(7) of the Yuma County Zoning Ordinance, action to grant an extension of time to comply with the Schedule for Development, determine compliance with the Schedule for Development, or cause the property to revert to its former Rural Area-40 acre minimum size (RA-40) zoning classification, Assessor's Parcel Nos. 186-33-005, -006, -007, -008 and -009 (previously 205-39-006), located at the northwest corner of Old Highway 80 and Avenue 37E, Wellton, Arizona.  (This case was continued from the April 2, 2018 meeting.)   NO ACTION-SCHEDULED/FUTURE ACTION 

EVENTS CALENDAR/CURRENT EVENTS:

1.        Board members and County Administrator will report on and may discuss events attended or to be attended on behalf of the County, may present a brief summary of current events and may update the schedule for future Board of Supervisors meetings, as appropriate. No legal action will be taken, pursuant to A.R.S. §38-431.02(K).  NO ACTION

WORK SESSION DISCUSSION AND ACTION ITEM: The Board will discuss and may take action on the following item(s) as appropriate:

1.        Development Services/Planning & Zoning: Overview of alternatives to existing and new schedules for development for planning cases.  (No official action is required. This item is continued from June 4, 2018.)   NO ACTION
