CALL TO ORDER 

PLEDGE OF ALLEGIANCE 

CALL TO THE PUBLIC:  Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date. 

PRESENTATIONS, PROCLAMATIONS & APPOINTMENTS: Note: During this segment of the agenda, board members may discuss the presentations and proclamations, and may announce appointments to the Yuma County Planning and Zoning Commission and the Yuma County Board of Adjustment. No legal actions will be taken.

1.      Presentation of "The County Line" by Yuma 77, the Yuma County Government Channel.  No Action

2.      Presentation of the 2017 Legislative Report by Craig Sullivan, Executive Director of the Arizona County Supervisors Association.  No Action

CONSENT CALENDAR:  The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action. 

1.        Assessor: Approve Tax Roll Corrections as listed in batch dated June 19, 2017, pursuant to A.R.S. Title 42, Chapter 16, Article VI.  (A full listing of all corrections is available from the Clerk of the Board of Supervisors.)  Approved as presented

2.        Financial Services: Approve the Accounts Payable Demands disbursed in the amount of $2,004,498.47 and Payroll in the amount of $1,513,711.89 during the period of May 10, 2017 through May 26, 2017. (A detailed listing is available for review in the Office of the Clerk of the Board of Supervisors.)  Approved as presented

3.       Clerk of the Board: Approve the June 5, 2017 Regular and Work Session minutes. Approved as presented

4.        Clerk of the Board:  Action to recommend State approval of Special Event Liquor License applications submitted by John Friel dba St. John Neumann Roman Catholic Church, 11545 E. 40th Street, Yuma, AZ 85367, for a fundraiser to be held Friday, December 15, 2017, Saturday, January 6, 2018, Friday, January 19, 2018, Saturday, February 10, 2018, and Monday, February 26, 2018.  BOS recommended approval

5.        County Administrator: Action to: a) Declare miscellaneous County Property as surplus to County needs as listed in Exhibit A for Development Services, Elections, General Services, Health Department, Housing, Juvenile Court, Library District, Public Fiduciary, Public Works, and the Sheriff's Office; b) Authorize auction items to be publicly auctioned online between July 14, 2017 and July 28, 2017; and c) Authorize the disposal of any items that are not sold at auction pursuant to the Yuma County Purchasing Policy. (Exhibit A is available for review from the Office of the Clerk of the Board of Supervisors.   Approved as presented

6.        Clerk of Superior Court: Adopt Budget Amendment Resolution No. 17-121, transferring $3,000 from contingency in Spousal Maintenance Fund to Supplies & Services/Small Tools line item.  Approved as presented

7.        Superior Court/Adult Probation:  Adopt Budget Amendment Resolution No. 17-122, increasing supplies and services by $16,000 and decreasing Salaries and ERE's by $16,000 in the State Aid Enhancement (SAE) fund. Approved as presented

8.        Public Health Services District:  Award and authorize the District Director to sign an agreement with Horizon Health and Wellness for Title 36 Mental Health Services in Yuma County in an amount not to exceed $1,600,000.00, effective July 1, 2017 through June 30, 2018.  Approved as presented

9.        Public Health Services District: Approve and authorize the Health Director to sign a Delegation Agreement No. AGR2017-055 between the Arizona Department of Health Services and the Yuma County Public Health Services District for enforcement activities for Food Safety and General Sanitation Control, Pure Food Control, and the Smoke-Free Arizona Act.  This agreement is effective July 1, 2017 through June 30, 2032.  Approved as presented

10.      Sheriff: Authorize the Sheriff to sign Amendment No. 5 to the contract between Yuma County and Victor Alvarez, P.C. for medical examiner services for an additional one (1) year period, from July 1, 2017 to June 30, 2018 with an increase of $35,000.  This would increase the annual cost of services from $201,708 to $236,708.  Approved as presented

11.      Sheriff: The Yuma County Sheriff's Office is requesting consideration from the Yuma County Board of Supervisors to fund the matching portion of the COPS Hiring Program (CHP) Grant to enable the Sheriff's Office to hire four (4) additional full time deputies.   Approved as presented

12.      Development Services/Flood Control District: Re-appoint Courtney Arviso to the at-large member position with the Flood Control Advisory Board for an additional 5-year term ending on August 20, 2022.  Approved as presented

13.      Development Services/Engineering: Approve the construction plans and authorize the Department of Development Services to advertise for bids for the following two Chip Seal Program Fall 2017 Projects (CIP No. 1.1702):  a) Yuma District; and b) Mohawk and East of Mohawk Pass District.  Approved as presented

14.      Free Library District: Confirm the reappointment of Francisco Vasquez to the Yuma County Free Library District Board of Trustees to represent the City of Somerton, effective July 1, 2017, for a three-year term ending June 30, 2020. (Mr. Vasquez’s current term ends June 30, 2017.)  Approved as presented

15.      Free Library District: Confirm the reappointment of Joyce Seriale to the Yuma County Free Library District Board of Trustees to represent the Town of Wellton, effective July 1, 2017, for a three-year term ending June 30, 2020. (Ms. Seriale’s current term ends June 30, 2017.) Approved as presented

16.      Free Library District: Confirm the reappointment of Africa Luna-Carrasco to the Yuma County Free Library District Board of Trustees to represent the City of San Luis, effective July 1, 2017, for a three-year term ending June 30, 2020. (Ms. Luna-Carrasco’s current term ends June 30, 2017.) Approved as presented

17.      Free Library District: Confirm the reappointment of Pat A. Riley, Sr., to the Yuma County Free Library District Board of Trustees to represent the City of Yuma, for a three-year term beginning July 1, 2017, and ending June 30, 2020. (Mr. Riley’s current term ends June 30, 2017.)  Approved as presented

18.      Free Library District: Confirm the appointment of Angie Creel to the Yuma County Free Library District Board of Trustees to represent Yuma County, effective July 1, 2017, for a three-year term ending June 30, 2020.  Approved as presented

19.      Justice Court: Approve: a) An Addendum to the Intergovernmental Agreement (IGA) between the City of Yuma and Yuma County for Yuma County to provide mandated weekend and holiday Court services as defined in Arizona Rules of Criminal Procedure 4.1(d) from July 1, 2017 through June 30, 2018; and b) Approve the invoice in the amount of $4,636.00 for the provision of said services. 20.      Justice Court: Approve: a) An Addendum to the Intergovernmental Agreement (IGA) between the City of San Luis and Yuma County for Yuma County to provide mandated weekend and holiday Court services as defined in Arizona Rules of Criminal Procedure 4.1(d) from July 1, 2017 through June 30, 2018; and b) Approve the invoice in the amount of $1,159.00 for the provision of said services. 21.      Justice Court: Approve: a) An Addendum to the Intergovernmental Agreement (IGA) between the City of Somerton and Yuma County for Yuma County to provide mandated weekend and holiday Court services as defined in Arizona Rules of Criminal Procedure 4.1(d) from July 1, 2017 through June 30, 2018; and b) Approve the invoice in the amount of $497.00 for the provision of said services. 22.      Justice Court: Approve: a) An Addendum to the Intergovernmental Agreement (IGA) between the Town of Wellton and Yuma County for Yuma County to provide mandated weekend and holiday Court services as defined in Arizona Rules of Criminal Procedure 4.1(d) from July 1, 2017 through June 30, 2018; and b) Approve the invoice in the amount of $165.00 for the provision of said services.  Approved as presented

23.      Justice Court: Adopt Budget Amendment Resolution No. 17-120, reducing the Contingency (02243.1101.46710) in Justice Court Precinct Two, in the Additional Assessment Fund by $3,000 and increasing the Office Supplies line item.   Approved as presented

24.      Superior Court/Juvenile Court: Adopt Resolution No. 2017-18, approving Juvenile Court participation in the Family Counseling Program; effective July 1, 2017 through June 30, 2018.   Approved as presented

HOUSING GOVERNING BOARD - CONSENT CALENDAR: The following item(s) listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action.

1.        Housing: Adopt and authorize Chairman to sign Resolution No. 2017-14 approving the amount of $4,165.90 to be written off as bad debt accounts.  Approved as presented

2.        Housing: Adopt and authorize Chairman to sign HUD 52574 PHA Board Resolution No. 2017-15 approving the Yuma County Housing Department’s Fiscal Year 2017-18 operating budget in the amount of $1,192,389. Approved as presented

3.        Housing: Approve the calculation of the operating budget for Fiscal Year Ending June 30, 2018 for the Yuma County Housing Department’s Section 8 Housing Choice Voucher program in the amount of $3,013,911.   Approved as presented

DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate.

1.        Justice Court: a) Pursuant to A.R.S. §11-251.08, conduct a Public Hearing to accept public comment on a proposed amendment to Resolution No. 2015-05/Justice Court Fee Schedule, and; b) Adopt Resolution No. 2017-16 increasing the Justice Court Enhancement Fee from $20 to an amount up to $40 effective July 1, 2017 and to supersede all previously adopted fee schedules. 2.        Public Works: As the Board of Supervisors: a) Hold a Public Hearing on June 19, 2017 at 9:00 a.m. to hear and pass upon any objections or protests presented to the Board regarding the establishment of a County Improvement District to update the existing water delivery system, and to be known as Yuma County Improvement District No. 2017-01 (Sun Leisure Estates); b) After ruling on all protests and objections presented, establish the district; and c) Authorize the Chairman to sign the appropriate formal Order of Establishment for said County Improvement District by recognizing that no objection or protest for consideration was received during the time provided by law, or find that all objections and protests presented for consideration are of insufficient cause and are overruled, except as specifically stated on "Exhibit B", to be included with the "Order Establishing Improvement District".  Other (See minutes)

3.        Public Works/Sun Leisure Estates Improvement District No. 2017-01: As the Board of Directors: a) Accept the Petition to Incur Expense for Sun Leisure Estates Improvement District No. 2017-01, as verified, to update the existing water delivery system within the District; and b) Authorize the establishment of a new fund number for the District.  Approved as presented

4.        Human Resources: Approve Personnel Rule (PR 401, 402, 403, 404, 405, 406, 411, 413, 417, 418, 419, 420, and 420) Benefits.   Continued
 

5.        County Administrator: Board of Supervisors approval of a letter of support for Yuma County Farm Bureau regarding ozone and PM10 emissions issues. Approved as presented 

SPECIAL SESSION:  Chairman recesses the Yuma County Board of Supervisors' Regular Session and convenes in Special Session.

1.        County Administrator/All Special Taxing Districts: Action by the Board of Supervisors to continue the adoption of the Yuma County Annual Budget for Fiscal Year 2017-2018 to June 26, 2017 at 9:00 a.m. to include the following: 
a)
Conduct a combined public hearing on the Fiscal Year 2017-2018 Annual Budget and the Truth and Taxation (primary & secondary property tax levies);  b) Adopt Resolution No. 2017-10, a joint resolution of the County, the Yuma County Flood Control District, Public Health District, Jail District, Library District and all Improvement and Special Districts, adopting the Yuma County Budget for Fiscal Year 2017-2018; and c) Adopt Resolution No. 2017-11, a joint resolution of the County, the Yuma County Flood Control District, Public Health District, Jail District, and Library District, adjusting Employee Compensation and Program Funding.  Continued

Chairman adjourns the Special Session and reconvenes the Yuma County Board of Supervisors in Regular Session.

EVENTS CALENDAR/CURRENT EVENTS:

1.        Board members and County Administrator will report and may discuss events attended or to be attended on behalf of the County, may present a brief summary of current events and may update the schedule for future Board of Supervisors meetings, as appropriate. No legal action will be taken, pursuant to A.R.S.§38-431.02(K). No Action

WORK SESSION DISCUSSION AND ACTION ITEM: The Board will discuss and may take action on the following item(s) as appropriate:

1.        Development Services: Presentation of Yuma Regional Development Plan to the Board.   Continued

2.        County Administrator: Discussion of County parks - history and future.  No Action
